RHODE ISLAND NON-RESIDENCE TAX
Rhode Island General Law 23-28.35-1 requires that any
non-resident landowner file a Rhode Island Non-Resident tax return with the
R.I. Division of Taxation prior to the closing. If the return is not filed prior to the closing the closing
Attorney is required by law to withhold 6% of the sellers net proceeds and
forward it to the R.I. Division of Taxation.
In the event the seller is a corporation the withholding is 9% of the
net proceeds.
R.I. SMOKE DETECTOR REQUIREMENTS
Under Rhode
Island General Law 44-30-71.3 it is required to have smoke detectors to
transfer properties containing residential dwellings and to present a smoke
detector certificate at or before the closing.
